Agreement Overview:

This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior agreements between all Parties. The only way to add or change this agreement is to do so in writing, signed by all Parties. If the Parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed the waiver in writing. Coverage will begin at the agreed time and date above, and continue for the agreed time purchased.

Upon agreeing you have read these booking policies, it confirms acknowledgement of having acknowledged the current product description & pricing available in the VIP Client Group, Rebekah Collins Photographer (Facebook page) and through any other communications between you and the photographer, Rebekah.

After your session you will be sent a gallery of images within 14 days, containing a minimum of 10 images. The gallery will be available for viewing for up to 4 days. After this time, if the client has not chosen the selected images, the gallery will be re-released for 1 week as per the Client's request, which will incur a storage & administration fee of £30. Additional images will be available to purchase as per the following: 5 digital image downloads for £100 {OR} USB of ALL images for £299.

Where a gift voucher is purchased, please direct the recipient to the terms of this document. Gift vouchers are valid 6 months from the purchase date.

Payment to Book:
A non-refundable, retainer fee of 50% is due at the time of booking to reserve your space in the diary – this will be deducted of the session fee. When a Themed Mini Session is purchased, the full fee of £50 will be required at the time of booking. Non-refundable retainer fees reserve my time for you and cease advertisements to otherwise fill that time. The reminder of the session fee is required up to 24 hours before your session time. Your booking is not complete until ‘Rebekah Collins Photographer’ is in receipt of these funds. Bookings may, with advanced notice, be transferred ONCE to another mutually acceptable date. In the case of sickness, please give as much notice as possible of a requirement to postpone.

Exclusive Photographer:

The Photographer, and/or any photographers hired by the key Photographer, shall be the exclusive photographer retained by the Client for the purpose of the session. Family and friends of the clients shall not interfere with the Photographer’s duties, from the booking of the session to the delivery of the images. In the unlikely event of a personal illness to the Photographer, and no other photographers are available, you may terminate this agreement and receive a refund of all fees paid, to date.

Use of Camera Phones:
Behind the scenes shots are permitted on camera phones only & we politely request they feature the working scene & not baby alone. We love to see your ‘behind-the-scenes’ images with the hashtag #rebekahcollinsphotographer & you can find us as @rebekahcollinsphotographer on Instagram.

Change of date and/or location:

The Photographer must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of the portrait session, by email for documentation. It is the Client’s responsibility to confirm all arrangements up to 7 days prior to the event. In the event of change of location or contact information, as listed, the Client must notify the Photographer, and to also go over final details. The Photographer will make every effort to contact the Client, but it is the Client’s responsibility to contact the Photographer to confirm all events, persons involved and times and to make them aware of any changes that would interfere for the services of RCP.

The Parties agree to cheerful cooperation and communication for the best possible result within the definition of this agreement and portrait session. The Photographer cannot be held responsible for requested photographs not taken or missed, or lack or coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the portrait session, or due to cameras, flashes, or the lateness of the clients. The Photographer recommends that the Clients point out important individuals for candid-style photographs, and will do their best to fulfil all requests but can make no guarantees that all images taken will be delivered.

At all times the photographer's artistic licence will be deemed as correct based upon your consultation. Working with small children brings no guarantees & no photographs are promised whether attempted during the session or otherwise. Children are at all times the responsibility of their guardians & safety directions should be followed. Should direction be repeatedly ignored, RCP & its associates reserve the rights to terminate the session on the grounds of safety.

If the Photographer notifies the Clients that the session should be re-scheduled due to the weather, and the Client continues with the session, but requests for it to be re-scheduled one hour before or during the session, the full amount of the session will be charged again. Clients are responsible for all location fees and any permits needed.

Should the photographer deem a re-shoot necessary, in agreement with the Client, a suitable appointment will be made at the discretion of RCP. However, re-shoots will not be offered to due lack of co-operation from clients.

The Photographer cannot be held responsible for damage to garments, and props brought by the Client, due to environmental events. The Client is responsible to arrange personal assistance for garments.

The copyright of the photographs remains the property of the photographer, Rebekah Collins. The client is not licensed to resell the photographs or to approve their use for publication by any other person, company or organisation INCLUDING FOR COMPETITIONS without the written agreement of the photographer.

Moral rights under the Copyright, Designs and Patents Act 1988 are asserted on all photographs referred to in this document.

The client shall not breach these regulations by means of downloading, screenshotting, copying in any other manner, altering or duplicating without specific permission with neither provided proof images nor full resolution purchased copies. THIS INCLUDES USE OF SOCIAL MEDIA FILTERS, STICKERS OR SIMILAR APPS.

Digital images are sold with a certificate of RIGHTS TO PRINT copyright remains with the photographer, as per UK law.

Creative Licence:

Images are hand-edited at the Photographer’s discretion and delivered digital images may not include all images taken during the portrait session. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards.

Use of Images:
The photographers confirm that they will not supply the photographs to any other person, company or organisation without the permission of the client except as detailed for purposes below.

The Client agrees that the photographer (including & not limited to their students & associate photographers) may use the work in their corporate publicity in forms acceptable to the client including but not limited to portfolio, web design, news, adverts and displays both in-house & off site.

Where commissioned, images that feature a person under 18, a signature confirms you have responsibility as a parent or guardian and agree to the use of said images as previously outlined in correspondence and above.

This agreement will be applied to all future sessions, via the ‘Client Questionnaire’, without further notice unless terms change.
